Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Wanderous Rentals LLC ("Company," "we," "us," or "our"), concerning your access to and use of our services and website.
By accessing our Services, you agree that you have read, understood, and agree to be bound by all of these Terms of Service. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF SERVICE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.
Supplemental terms and conditions or documents that may be posted on the Services from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Service at any time and for any reason. We will alert you about any changes by updating the "Last updated" date of these Terms of Service, and you waive any right to receive specific notice of each such change.
It is your responsibility to periodically review these Terms of Service to stay informed of updates. You will be subject to, and will be deemed to have accepted, the changes in any revised Terms of Service by your continued use of the Services after the date such revised Terms of Service are posted.
1. Our Services
Scope of Services
Wanderous Rentals LLC provides rentals of a 2023 East to West Della Terra travel trailer and various outdoor gear including kayaks, bikes, tents, and related equipment (collectively, the "Rental Equipment" or "Services"). All rentals are subject to availability and the Company may refuse any booking at its sole discretion. Rental periods and add-on options (which may incur additional costs) are determined at the time of booking.
User Requirements
Users must be at least 25 years old to use our Services or book rentals. Persons under 25 are not permitted to register, book, or rent from us. This age requirement is standard in the RV and recreational rental industry for safety and insurance purposes. By using our Services, you represent that you meet this age requirement.
User Responsibilities
As a renter, you agree to:
- Return all Rental Equipment in the same condition as provided (normal wear and tear excepted)
- Pay additional fees to cover repairs or replacement for any damage or loss of Rental Equipment during your rental period
- Follow all provided safety guidelines and instructions for using the trailer and equipment
- Use the Rental Equipment in a lawful and responsible manner
If you fail to adhere to safety rules or engage in misuse of the Rental Equipment, the Company reserves the right to terminate the rental immediately without refund.
Compliance Note
The information and Services provided are not intended for use in any jurisdiction where doing so would violate local law or require the Company to register in that jurisdiction. Users who access the Services from outside our intended service area (Northeast Ohio) do so on their own initiative and are responsible for compliance with their local laws.
2. Intellectual Property Rights
Our Content and Marks
Unless otherwise indicated, the Services and all content on our website (including text, graphics, logos, images, software, and design) are the property of Wanderous Rentals LLC or our licensors, and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws. The Wanderous name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of the Company or its affiliates or licensors (collectively, our "Marks"). You may not use our Marks without our prior written permission.
Limited License to Users
Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services and download or print content from the Services for your personal, non-commercial use only. You may not copy, reproduce, distribute, publicly display, or create derivative works from the Services or our content without our written permission.
User Submissions (Feedback)
If you provide us with any suggestions, ideas, feedback, or other submissions ("Submissions"), you automatically assign all intellectual property rights in those Submissions to the Company. We will own the Submissions and may use them freely for any purpose without compensating or crediting you.
3. User Representations
By using the Services, you represent and warrant that:
- You have the legal capacity to enter into this agreement and are of legal age (at least 25 years old)
- You are not a minor in your jurisdiction of residence
- You will not access the Services through automated or non-human means (such as bots, scripts, or web scrapers)
- You will not use the Services for any illegal or unauthorized purpose
- Your use of the Services will comply with all applicable laws and regulations
- All information you provide is accurate, current, and complete
If you provide any information that is false, inaccurate, incomplete, or outdated, we may suspend or terminate your account and refuse any current or future use of the Services.
4. Purchases and Payment
Payment Information
When making a purchase or booking through our Services, you agree to provide current, complete, and accurate billing and payment information. You must promptly update your account information with any changes to your billing details.
Accepted Payment Methods
We accept the following payment methods: Visa, Mastercard, American Express, Discover.
Pricing and Taxes
All prices are stated in United States dollars (USD). Applicable sales taxes will be added to your total as required by law. The Company reserves the right to change prices at any time.
Authorization and Corrections
By placing an order or making a booking, you authorize Wanderous Rentals LLC to charge your chosen payment method for the total amount due, including any applicable taxes, fees, and delivery charges. We may correct errors, refuse or cancel any order, limit quantities, and cancel orders that appear to be placed by resellers. If we cancel an order after your payment has been processed, we will issue a refund to your original payment method.
5. Cancellation Policy
- 7+ Days Before Check-in: Full refund (100% of amount paid)
- Less than 7 Days Before Check-in: 50% refund
- Within 48 Hours of Check-in: No refund (0%)
Cancellations must be submitted in writing via email to support@wanderous.co
Refunds will be processed to the original payment method within 7-10 business days
This policy applies regardless of the reason for cancellation
No exceptions are made for weather conditions, changes in plans, or emergencies
6. Prohibited Activities
You may not access or use the Services for any purpose other than that for which we make the Services available. The Services may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us. Prohibited activities include legal violations, harm to others, technical misuse, platform abuse, sending spam, and misuse of Rental Equipment. Violation of any prohibited activities may result in immediate termination of your access to the Services, forfeiture of deposits or payments, and potential legal action.
7. User-Generated Contributions
The Services may invite you to submit content, including comments, reviews, feedback, messages, or other materials ("Contributions"). Any Contributions you make must be your own original work or content for which you have obtained all necessary rights and permissions, not infringe third-party rights, not contain unlawful, hateful, or obscene material, and comply with all applicable laws. We reserve the right to monitor, remove, or edit any Contributions that violate these Terms.
8. Contribution License
By submitting any Contribution, you grant Wanderous Rentals LLC a perpetual, worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the Contribution in connection with the Services and our business. You retain ownership but grant us these rights and waive any claims regarding our use of your Contributions.
9. Third-Party Websites and Content
The Services may contain links to third-party websites or display content from third parties that are not owned or controlled by Wanderous Rentals LLC. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites. Use third-party websites at your own risk, and review their terms and privacy policies.
10. Services Management
We reserve the right, but not the obligation, to monitor the Services for violations, take legal action against violators, remove or disable access to content, manage the Services to protect our rights and property, and suspend or terminate your access at our discretion.
11. Privacy Policy
Your use of the Services is governed by our Privacy Policy, which is incorporated by reference. Our Services are hosted in the United States; if you access from outside the United States, you consent to data transfer and processing in the U.S.
12. Term and Termination
These Terms remain in full force and effect while you use the Services. We may terminate or suspend your access immediately, without prior notice or liability, for any breach of these Terms, unlawful activity, or at our sole discretion. Upon termination, your right to use the Services ceases, you must discontinue all use, and we may delete your data subject to legal retention requirements.
13. Modifications and Interruptions
We reserve the right to change, modify, or remove the contents of the Services at any time and for any reason without notice. We do not guarantee the Services will be available at all times or be uninterrupted or error-free, and we are not liable for any modification, suspension, or discontinuance of the Services.
14. Governing Law
These Terms and your use of the Services are governed by and construed in accordance with the laws of the State of Ohio, specifically Summit County, Ohio, without regard to its conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods (CISG) and the Uniform Computer Information Transactions Act (UCITA) do not apply.
15. Dispute Resolution
Both parties agree to attempt to resolve any dispute through good-faith informal negotiations for at least 30 days before initiating formal legal proceedings. No dispute may be brought more than one (1) year after the cause of action arose, except for disputes involving intellectual property, privacy, or requests for injunctive relief, which may proceed directly to court. Any legal action shall be brought exclusively in the state or federal courts located in Summit County, Ohio.
16. Corrections
There may be information on the Services that contains typographical errors, inaccuracies, or omissions, including pricing, availability, or product descriptions. We reserve the right to correct any errors and to change or update information at any time without prior notice.
17. Disclaimer of Warranties
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. YOU AGREE THAT YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT CONTENT WILL BE ACCURATE OR RELIABLE.
18. Limitations of Liability
To the fullest extent permitted by applicable law, in no event will Wanderous Rentals LLC, its affiliates, directors, officers, employees, agents, suppliers, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill. Our total liability to you for any damages arising from or related to these Terms or your use of the Services shall be limited to the lesser of (1) the total amount paid by you to us in the three (3) months immediately preceding the event giving rise to liability, or (2) $0 if you have not made any payments to us.
19. Indemnification
You agree to defend, indemnify, and hold harmless Wanderous Rentals LLC, its affiliates, and their respective officers, directors, employees, agents, service providers, contractors, licensors, suppliers, successors, and assigns from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or relating to your use of or access to the Services, your breach of these Terms, your violation of any third-party rights, your violation of any applicable law, any Contributions you make, any damage or harm caused by your use of the Rental Equipment, or any willful misconduct or negligence on your part.
20. User Data
We will maintain certain data that you transmit to the Services for the purpose of operating and managing the Services and complying with legal obligations. You are solely responsible for all data you transmit and for maintaining backup copies of any data you provide. We are not liable for any loss or corruption of data. Upon termination, we may delete data associated with your account, subject to legal retention requirements.
21. Electronic Communications and Signatures
By using the Services, you consent to receive electronic communications from us. You agree that all agreements, notices, disclosures, and other communications provided electronically satisfy any legal requirement that such communications be in writing. Clicking "I Agree," "Book Now," "Submit," or similar, or using the Services after being presented with these Terms, constitutes your electronic signature and agreement to be bound by these Terms.
22. California Users and Residents
Under California Civil Code Section 1789.3, California users are entitled to the following consumer rights notice: If you have a complaint regarding the Services that you are not able to resolve with us directly, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs, 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, telephone (800) 952-5210 or (916) 445-1254.
23. Miscellaneous
These Terms, together with our Privacy Policy and any other legal notices or agreements published by us on the Services, constitute the entire agreement between you and Wanderous Rentals LLC concerning the Services. Our failure to exercise or enforce any right or provision shall not operate as a waiver of such right or provision. If any provision is deemed unlawful, void, or unenforceable, the remaining provisions remain in full force and effect.
